Armenia’s Constitutional Court is set to hear arguments on January 12 on whether the Turkey-Armenia Protocols are constitutional.
The content of the Protocols signed between Turkey and Armenia clearly run counter to the founding Constitution, and the Declaration of Independence on which it is based. Specifically, they contradict the clauses of the initial aspirations declared on August 23, 1990, which bases independence on “developing the democratic traditions of the independent Republic of Armenia established on May 28, 1918” and that “The Republic of Armenia stands in support of the task of achieving international recognition of the 1915 Genocide in Ottoman Turkey and Western Armenia” [our emphasis].
If the ordinary citizens of Armenia are required to uphold and adhere to Armenia’s Constitution and Declaration of Independence, than surely the President and those in power must also.
Take a stand today and call on the Constitutional Court of the Republic of Armenia to acknowledge the unconstitutionality of the Turkey-Armenia Protocols.

- The content of the Protocols signed between Turkey and Armenia clearly opposes the statement declared on August 23, 1990, going against the constructing points and base of the Constitution of the Republic of Armenia. Violations of the following points are of particular concern:
- “Aware of its historic responsibility for the destiny of the Armenian people engaged in the realization of the aspirations of all Armenians and the restoration of historical justice”
- “Developing the democratic traditions of the independent Republic of Armenia established on May 28, 1918;”
- “11, The Republic of Armenia stands in support of the task of achieving international recognition of the 1915 Genocide in Ottoman Turkey and Western Armenia.”
- Armenia should establish natural diplomatic relations with Turkey but not at the expense of the acknowledgement of the Armenian Genocide, our lands and the independence of Nagorno-Karabakh.
- The adoption of these protocols would put at risk the legitimate Armenian territorial claims, jeopardize the ambition for international recognition of the Armenian Genocide & endanger the rights of the people of Nagorno Karabakh to self-determination
- The Armenian President, in his speech on October 10th, clearly acknowledged the concerns put forth by the majority of the Armenians in Armenia and the Diaspora. The President also indicated that Armenia will not let Turkey question the facts of the Armenian Genocide and will not let the protocols put Nagorno-Karabakh in danger.
I am against the Constitution Court to approve the Protocols to send to Parliment for ratification. In fact we as diasporan Armenians have the full write as the Armenians living in Armenia to join them to null the signatures between our President Serge Sargsyan and Turkey’s Prime Minister Erdogan. This hypothethical issue belongs to every sinle Armenian around the world to stand against it for the interest of our beloved homeland. Like you give the lamb to Wolves for custody. Wake up Mr. President before we loose our homeland, Karaghabagh, the road map. This is a hoax, how a single Armenian acknowledges the Turkey’s criminal act the 1915 Genocide of 1.5 million, more than two million our parents, ancestors, everyone had to be cruelly deported to the hot desert of rape, murder you well know Mr. President the whole facts. Therefore, we kindly ask you if you have forgotten our justice and wheat Armenians, most civilized nation had to go through the most hienous crime, then we ask you to set aside if you lack the politics. You did it alone with your Foreign Minister, Mr Edward Nalbandian the cold blooded, I don’t even regard him as a true Armenian such as yourself. Please resign or you what the consequences of your nation, this is not a threat, but it is a mater of degnity. We can’t forget or forgive criminal Turks who up to day deny the acknowledgement of the Genocide and lie to the whole world that their ancestors didn’t kill Armenians, the owner of their own homeland, peaceful, defendless, innocent but smart intelligent, had to be the innocent victems on what condition had to leave their homes, belongings, everything they owned. Shame on both of you and your collaborators who are looking for the interest of their own pocket stabbing their behind their back without consulting with its nation. Shame on you to cave in for the monester enemy beside you. Remember our victims are screaming for justice they will curse you, how you decide your nation’s destiny selling out our homeland to the enemy who they owe us acknowledgement and reparation of our ancestors robbed belongings. I think you don’t have a bit of conscious, just want to represent yourself as a prominent Armenian President to super powers who are twisting your arms, then we have your answer, you are nothing but betrayer of our Armenian nation. You are the one proposed to invite Gul for Football game without any precondition then shamelessly you attended the second game in Turkey. Հաստատելով, որ
Իբրեւ հարեւան պետութիւններ` Հայաստանն ու Թուրքիան ի վերջոյ պէտք է քայլեր ձեռնարկեն յարաբերութիւնների բնականոնացման ուղղութեամբ: Սակայն երկու երկրների միջեւ բարիդրացիական յարաբերութիւններ կարող են հաստատուել Թուրքիայի կողմից Հայոց ցեղասպանութեան ճանաչմամբ եւ հայ ժողովրդի իրաւունքների վերականգմամբ միայն: Առանց նախապայմանների դիւանագիտական յարաբերութիւնների հաստատումը եւ շրջափակման վերացումը այս ճանապարհի սոսկ առաջին քայլերն են:

ՀՀ նախագահը 2009թ հոկտեմբերի 10-ի իր ուղերձում մասնաւորապէս հաստատեց « որ Թուրքիայի հետ ցանկացած յարաբերութիւն չի կարող կասկածի տակ դնել Հայոց Ցեղասպանութեան իրողութիւնը եւ հայ ժողովրդի հայրենազրկման փաստը» Հայաստանի եւ Թուրքիայի միջեւ առկա է սահմանների խնդիր. ստորագրուած փաստաթղթերը որեւէ ձեւով չեն կարող առնչվել Լեռնային Ղարաբաղի հիմնախնդրի կարգաւորման հետ:
Սակայն ՀՀ Նախագահի ուղերձը լինելով քաղաքական փաստաթուղթ իրաւականօրէն չի ազդում Արձանագրութիւնների բովանդակութեան վրայ: Մանաւանդ որ Թուրքիան Արձանագրութիւնների խնդրահարոյց գլխաւոր կէտերը մեկնաբանում է ՀՀ նախագահի մեկնաբանութիւններին ամբողջութեամբ հակառակ ձեւով:
Թուրքիան Արձանագրությունները մեկնաբանում է այնպէս որ Հայաստանը եւ Թուրքիան ընդունել են միմեանց տարածքային ամբողջականութիւնը եւ միմեանց սահմանները եւ ոչ մի կասկած չկայ միմեանց սահմաններն ընդունելու վերաբերեալ: Թուրքիայի արտգործնախարարի համաձայն.«Այս արձանագրութիւնով մենք մի անգամ եւս վավերացնում ենք մեր սահմանների ճանաչումը եւ Նախիջեւանի հարցում մեր ստանձնած միջնորդի դերը»: Ըստ Թուրքիայի Արձնագրությունների համաձայն կազմուելիք պատմական միջկառավարական ենթահանձնաժողովը աշխատելու է երկու կառավարութիւնների հսկողութեան ներքոյ, առարկայականօրէն, գիտականօրէն եւ անկողմնակալ կերպով ուսումնասիրելու է բոլոր արխիւները, ինչը նշանակում է, որ այլեւս Հայաստանն էլ ընդունում է, որ հնարաւոր չէ այսպէս կոչւած միակողմանի ընկալմամաբ գտնել հարցերի լուծումները. եւ նախատեսւում է, որ երկու երկրների ժողովուրդների միջեւ կարեւոր պատմական իրադարձութիւնների հետ կապված խնդիրները կը յստակեցուեն եւ ճշմարտութիւնը ջրի երես դուրս կը գայ: Վերջապէս Թուրքիան յայտարարում է որ իր երրորդ նպատակն է եղել այս Արձանագրութիւնների միջոցով Հայաստանի եւ Ադրբեջանի հակամարտութիւնը լուծել համաշխարհային իրաւունքի եւ Ադրբեջանի տարածքային ամբողջականութեան հիման վրայ:
Ներկայ բովանդակութեամբ վաւերացուելու դէպքում այս Արձանագրութիւնները վստահօրէն դառնալու են Հայաստանի եւ Թուրքիայի միջեւ երկար վէճերի նոր առիթ ինչը եւս կը նպաստի Թուրքիայի հետապնդած նպատակներին:
Բաւարարելով Թուրքիայի կողմից առաջ քաշուած նախապայմանները, 2009թ հոկտեմբերի 10-ին Ցիւրիխում ստորագրուած Հայաստան-Թուրքիա Արձանագրութիւնները հակասում են ՀՀ Սահմանադրութեան հիմքը կազմող Հայաստանի անկախութեան մասին հռչակագրում հաստատագրված հայոց պետականութեան հիմնարար սկզբունքներ[ին] եւ համազգային նպատակներ[ին] յատկապէս՝ 1990թ օգոստոսի 23-ի վերոյիշեալ հռչակագրի հետեւեալ տրամադրութիւններին:
Գիտակցելով իր պատասխանատուութիւնը հայ ժողովրդի ճակատագրի առջեւ համայն հայութեան իղձերի իրականացման եւ պատմական արդարութեան վերականգնման գործում
Հիմնուելով 1989 թուականի դեկտեմբերի 1-ի Հայկական ԽՍՀ-ի եւ Լեռնային Ղարաբաղի վերամիաւորման մասին Հայկական ԽՍՀ Գերագոյն խորհրդի եւ Լեռնային Ղարաբաղի Ազգային խորհրդի համատեղ որոշման վրայ՝
Հայաստանի Հանրապետութիւնը սատար է կանգնում 1915 թվականին Օսմանեան Թուրքիայում եւ Արեւմտեան Հայաստանում Հայոց ցեղասպանութեան միջազգային ճանաչման գործին:
